Pedro, from what I have been reading most of the problems so far have been to pre-2007 models. I surmise there is not enough time yet to determine if the problem persists. A number of years ago we had a very bad ice storm in Atlanta - topped with a few inches of snow. At the time I lived at the bottom of long hill. My wife had planned a very nice multi-course dinner party that night but none of the guests could come. It is true engines don't routinely blow up at less than 50,000 miles - but it does happen. If a court were to apply that doctrine, it would in effect be saying that there was negligence in every case that any product failed earlier than its expected life. Remember - we are talking about small claims court with little or no discovery. Without regard to possible deal ending issues such as statute of limitations, Proving negligence in such a case without experts and extensive discovery is almost impossible. Maybe - but I think this is fairly clear cut from a legal viewpoint. I can assume that when the car was purchased some document was signed that said the only warranties were the specific warranties given at that time in writing. In this case, he bought the car from a Dodge dealer - thus no warranty from Porsche and no privity. I have appeared many times in small claims court on behalf of banks and corporations - and have never lost (knock on wood); of course, I always settle any cases where I think we might lose. The costs are not really that high - rarely is much, if any, discovery necessary for the defendant - in this case - just an appearance with a copy of the warranty would probably be adequate. I don't have Sirius but have XM. I assume the antennas are pretty much the same. In my Boxster, I have installed the antenna inside the front window in the center. I occasionally get a drop out in the mountains - but the performance with that placement is pretty comparable to the external antenna placement on my other cars. The fact that you did not get the same treatment as others is probably not going to get you very far. There is no rule that a manufacturer has to be consistent in handing out its "good will adjustments." Apparently, Porsche did not have much "good will" for you.by Lawdevil & CURVN8R - Main Forum
Since (i) meaningful discuovery is impractical, (ii) you would be up against very experienced defense lawyers, and (iii) small claims judges are probably very disinclined to make new law - particularly in the face of a written warranty limited to a certain number of years or miles. mikeby Lawdevil & CURVN8R - Main Forum

Thank you very much, Pedro. I needed this board after the last week . I was supposed to be on a month long cruise but my wife fill and broke her femur near the hip in Tunis last week. Just got back after spending a week following her surgery. I have been sleeping sleeping in a Tunisian hospital on a sofa the entire time.
