NBC: tire tread

Hi,
Sorry, nothing about Boxsters, but I didn't know where else to post...
I got some new tires on wife's Hyundai, and after fewer than 500 miles, I noticed a chunk that's becoming detached as shown below.
Some questions
1) Is this a tire defect and am I entited to warranty replacement? They're Kumhos purchased from tire rack.
2) Is it dangerous and should I replace the tire?
3) If it's not a defect, what could have caused it?

Looks like something cut it, and to do that to a tread, it had to be pretty severe. There could be belt damage, subtle as it might be. I wouldn't be comfortable with it.

possibly a bopx cutter in shipping, or a piece of transport equipment.

Since it is in the tread (check it does nto go through) it is not unsafe, for normal duty

I would carefully cut off the flap at the base.
Measure at it's thickest and compare with the tread depth.
If the tread depth is more, then it didn't cut into the belts which are the structural component of the tire.
From your photo it doesn't look that bad and certainly looks like it ran over something sharp that cut into the rubber.
