Service guy yesterday said they inspected the clutch and determined there was an issue with "wear and tear" and offered to split the cost of the fly-wheel and clutch replacement - total cost of $3400 which would require me to put $1700 into it. Again, there are 33,500 miles on the car and I've only put about 2500 miles on it. I'm incredulous. I just called the GM there and explained that I've beby Meredith in Atlanta - Main Forum
I told him I was disturbed by the call last night from the service guy that I'm dealing with. I explained that I’ve only put (at most) 2500 miles on the car, that I’ve bought 5 Porsches from Jim Ellis. That it is CPO. My sales-guy came to my side during the entire transaction on Saturday. He really seemed to be concerned about my service. He's been with Jim Ellis for 14 years, mostly with Porsche. Clutch seems fine to me. Charley agrees. Indeed It's a little stiff, but it certainly hasn't bothered me. It wouldn't have occurred to me to have them test it. One other clue that I didn't like. When I told him that I just bought the car CPO, his first question was "Who did you buy it from"? I said, "Jim Ellis" (You!). I got the feeling he was out to take advantage of me. Bought this car CPO in November. CPO good through 2016. Saturday, Charley and I were at the dry cleaner, came back to the car after 10 minutes (max) and the battery is dead. Called Roadside Assistance who jumped us, then we took the car up to Jim Ellis for service. Volvo Legal would rather see short-term, that they can't reproduce the problem, thus the problem doesn't exist. Buying me off solves the immediate problem, and saves them the cost of having to go to arbitration, which I would probably lose anyway without having codes to prove there's a problem. Volvo's not quite making me whole, but they're willing to accept some responsibility. At some point, unless you can really prove it, you have to make a decision that you're either going to fight to the bitter end or get on with your life. I may lose some $$, minimal if I can resell, but I'd rather put it behind me. Just bothers me that Volvo won't take responsibility for what is clearly a lemon.by Meredith in Atlanta - Main Forum
The second Volvo service manager reported to me today that they simply can't reproduce it, which is the frustrating thing about this throttle/computer issue. Volvo Corporate has upped their settlement offer (I'm holding out for a little more) and I can transfer the lease to a potential customer via swapalease.com (I've already worked it out with the bank and swapalease - I just need to pull the tby Meredith in Atlanta - Main Forum

Thanks guys. I have documented pretty much all of that as part of filing for the lemon law. Letters, copies of service reports, etc... I have great paperwork - the problem is that it's nearly impossible to reproduce because it is so sporadic - since Volvo has been unable to reproduce it, they can claim it's my fault. He said Volvo is usually ok to deal with ... he also said that I can probably negotiate for more if I decide to settle. To reiterate, my husband witnessed the last event - I was so glad. I did second-guess myself the first time it happened, but in November it was very clear that the engine was over-riding the brakes. Hey - Bear with me as this is not Boxster-related but anyone with experience with lemon law, please advise. I bought a 2012 Volvo S60 in January 2012. In January 2013, I was driving on the connector here in Atlanta and suddenly the motor seized and over-rode the brakes. Fortunately I was able to get to the side of the highway.
